Auto insurance is mandatory in Illinois.
Insurance regulations in the state of Illinois are governed by the Illinois Department of Insurance, which balances requirements mandated by the Illinois legislature and the federal government in order to make sure consumers are compliant with laws and companies don't take advantage of consumers. The most common regulations most Illinois residence face come in the form of the state's mandatory automobile insurance laws.
Vehicle Insurance
All Illinois motorists must have liability for their vehicles. This includes cars, vans, RVs, buses, motorcycles and commercial trucks.
Minimum Coverage
Vehicles must be insured to allow for $20,000 in liability for an injury or death of one person in an accident; $40,000 for the injury or death of more than one person in an accident; and $15,000 for damages to the property of another person.
Proof of Insurance
The state requires each vehicle to include an insurance card, proving to authorities that the vehicle is properly insured. Each motorist is responsible for getting this card from their insurer.
Action if Uninsured
The state conducts random checking of vehicle owners. Some drivers will receive questionnaires asking to provide the name of the insurance company and policy number. Others can be checked if they are involved in an accident or stopped for another violation. If drivers fail to verify they have insurance, driving privileges can be suspended. Motorists who cannot provide proof of insurance during a traffic stop can be fined $500. No one may operate a vehicle after the license plates have been suspended. A minimum fine of $1,000 can be issued if their license plates have been suspended because of a previous insurance violation.
Reinstatement Process
First-time offenders can get their licenses returned after paying a $100 fee and providing proof of insurance.
Other Regulations
The Illinois Department of Insurance also regulates or oversees insurance matters for pets, health care, college students, life insurance and homeowners. Regulations for each of these divisions is available at the agency's website (see the link in Resources).
