How Long Are Filed Insurance Claims Kept In Tennessee

Insurance companies use your claims history to assess how much of a risk you are. Insurance vendors also use the claims history on your home to assess how much risk your home represents, according to ConsumerReports.org.


Consumer Reporting Agencies

In Tennessee and other states, your automobile and homeowner's insurance claims for the past three to seven years may be retained and sold by consumer reporting agencies, such as ChoicePoint and A-PLUS to insurance agencies, according to ConsumerReports.org. Insurance agencies use your claims history to determine your insurance eligibility and premium.


Tennessee All Payer Claims Database


Tennessee Code Annotated 56-2-125 requires the Tennessee Department of Commerce and Insurance or its designee to collect eligibility, medical claims, and pharmacy claims data from group health plans and health insurance issuers. As of 2010, Tennessee has contracted with ONPOINTCDM, a claims database company, to collect this data. Under Tennessee Rules, Chapter 0780-01-79, all health plan administrators and third-party administrators, including pharmacy benefit managers, with Tennessee residents as covered individuals are required to register with ONPOINTCDM. Insurance claims filed in Tennessee are retained by ONPOINTCDM for three to seven years.


Health Insurance


Your medical records and resultant claims in Tennessee must be retained for up to 10 years from the last professional contact with the patient. The records of minors must be kept for one year after the age of maturity or 10 years after the last patient contact, whichever is longer. Some records are kept indefinitely, such as records for an incompetent individual and immunization records for all patients. X-rays, radiographs, and other imaging products may be destroyed after four years, but only if there is a separate report interpreting the images. Mammography records must be kept for 20 years. The records of patients involved in any type of dispute must be retained until the dispute has been resolved.


TennCare Medicaid Program


TennCare is Tennessee's Medicaid Program, providing health services for 1.2 million residents of Tennessee. Due to a long-standing class-action lawsuit, a litigation hold was put in effect for all documents relating to any contract or service provided by or on behalf of TennCare. As late as September 2011, all related documents were required to be retained indefinitely.
